This Terms of Service ("Agreement") constitutes a binding contract between
INSERVERS PVT. LTD. (hereinafter referred to as "Inservers") and the customer
("Customer"). By
using Inservers' services ("Services"), you agree to comply with and be bound by the terms set
forth herein.
[1.1] Customer: Refers to an individual person who is at least 18 years of age or a legally recognized artificial person (e.g., corporation, partnership) that agrees to the terms of this Agreement.
[1.2] Services: Includes dedicated servers, virtual private servers (VPS), Windows RDP services, and related offerings provided by Inservers.
[1.3] Agreement: Refers to this Terms of Service document, which constitutes a binding contract between Inservers and the Customer.
[2.1] Account Creation: Customers are required to provide accurate, complete, and current information during account registration. Failure to do so may result in suspension or termination of services.
[2.2] Account Security: Customers are responsible for maintaining the confidentiality of their login credentials. Inservers shall not be liable for unauthorized account access resulting from negligence.
[2.3] Verification: Inservers may require government-issued identification or additional verification to process certain orders, especially for high-risk transactions or dedicated server purchases.
[3.1] Backup Responsibility: Inservers is not responsible for the security, backup, or integrity of customer data. Customers must maintain their own backups unless subscribing to Inservers' paid offsite backup services.
[3.2] Paid Backup Services: Backup services, if availed, are stored on offsite servers and are subject to additional fees. Customers must ensure compliance with the terms of the backup service.
[3.3] Data Loss: Inservers shall not be held liable for data loss under any circumstances, including hardware failure, human error, or malicious activities.
Inservers' Fair Usage Policy is designed to ensure optimal performance and
security for all
users. Customers must not:
● Use servers for cryptocurrency mining, DDoS attacks, or port scanning activities.
● Host or distribute content that violates copyright laws, including pirated material or
software.
● Use servers for sending spam, unsolicited bulk emails, or phishing activities.
● Run public proxies, TOR exit nodes, or any services that may jeopardize network security.
● Conduct illegal activities, such as hosting malicious content, participating in hacking, or
distributing malware.
● Exploit server resources in a manner that impacts other customers or the overall
network.
● Use bandwidth in a manner inconsistent with the allocated limits (see
Section 6).
Violations may result in immediate suspension or termination without
prior notice or refund.

[6.1] Definition: Unmetered bandwidth refers to no specific billing for bandwidth usage but includes limits based on server specifications:
[6.2] Overage Charges: Usage exceeding the specified limits may result in additional fees or service throttling.
[6.3] Abuse: Excessive bandwidth consumption or activities such as hosting illegal content or running high-traffic applications without prior notice is prohibited.
Inservers guarantees a minimum network uptime of 99.9%. This excludes:
● Scheduled Maintenance: Downtime required for planned system upgrades or repairs.
● Force Majeure Events: Events beyond Inservers' reasonable control, including natural
disasters, government actions, or third-party failures.
● Customer Actions: Downtime caused by customer misuse, configuration errors, or
third-party software.
If uptime falls below the guaranteed level due to reasons within Inservers' control, customers
may be eligible for service credits. Requests must be submitted via the Customer Portal.
[8.1] Hardware Replacement: In the event of hardware failure, Inservers will replace the defective hardware within 24 business hours.
[8.2] Irreparable Failures: If hardware cannot be replaced or the service cannot be delivered, Inservers will issue credits or refunds for the affected period.
[8.3] Exclusions: This warranty does not cover issues caused by customer negligence, unauthorized modifications, or third-party software.
[9.1] Prohibited Actions:Bank chargebacks or payment gateway disputes initiated by the Customer are strictly prohibited.
[9.2] Consequences: Initiating a chargeback may result in:
Customers must resolve billing issues directly with Inservers via the support team.
Inservers reserves the right to suspend or terminate services under the
following conditions:
[10.1] Policy Violations: Breach of any terms outlined in this
Agreement.
[10.2] Non-Payment: Failure to pay invoices within the due date may result in service suspension.
[10.3] Security Risks: Detection of malicious activities, including DDoS attacks, unauthorized access attempts, or hosting illegal content.
[10.4] Legal Compliance: Inservers may suspend or terminate services to comply with applicable laws, regulations, or governmental requests.
[10.5] Immediate Actions: Inservers reserves the right to take immediate action to prevent damage to its infrastructure or other customers, including suspending services without prior notice.
[11.1] Scope of Support: Inservers provides support strictly related to server-level issues, including:
[11.2] Exclusions: Inservers does not offer support for:
[11.3] Support Channels: Support requests must be submitted through the Customer Portal or via official communication channels. Inservers does not guarantee support for issues raised via unauthorized methods.
[12.1] Testing Prohibited: Customers are strictly prohibited from testing DDoS attacks or other malicious activities either from or against Inservers' servers.
[12.2] Immediate Termination: Violations will result in immediate account termination without refund and potential legal action.
[13.1] Local Jurisdictions: Customers must comply with all applicable local, national, and international laws.
[13.2] Prohibited Content: Hosting or transmitting content that violates copyright, trademark, or any applicable laws is strictly prohibited.
[13.3] DMCA Compliance: Inservers adheres to the Digital Millennium Copyright Act (DMCA). In the event of a valid copyright infringement notice, Inservers reserves the right to take appropriate action, including disabling access to the infringing content.
[14.1] Inservers shall not be liable for:
[14.2] Maximum Liability: Inservers' liability is limited to the fees paid by the customer for the affected service in the previous 30 days.
[15.1] Billing Cycle: Services are billed in advance on a monthly, quarterly, or annual basis as per the subscription plan.
[15.2] Late Payments: Late payments may incur a fee of up to 5% per month.
[15.3] Non-Payment Consequences: Services may be suspended or terminated for nonpayment.
[16.1] This Agreement shall be governed by the laws of India
[16.2] Jurisdiction: Disputes shall be resolved exclusively in the courts of Uttar Pradesh.
[16.3] Arbitration: Parties may mutually agree to resolve disputes through arbitration under Indian arbitration laws.
Inservers reserves the right to modify this Agreement at any time. Updates will be posted on the website, and continued use of services constitutes acceptance of the revised terms.
